End User License Agreement (EULA)

By purchasing, accessing, or otherwise using the XpressPads online courses and related training materials (collectively, the "Course Content"), you agree to be bound by the terms of this License Agreement. If you do not agree to these terms, do not access or use the Course Content.

This License Agreement shall supersede any verbal or prior written statement or agreement to the contrary.

1. Ownership & Intellectual Property

The Course Content is proprietary to ficox UG (haftungsbeschränkt) ("ficox"). Access to the Course Content is licensed, not sold, to you. You acknowledge and agree that: (a) the Course Content is protected under copyright laws and international copyright treaties; (b) ficox retains all copyrights and other intellectual property rights in the Course Content; (c) there are no implied licenses under this agreement, and any rights not expressly granted to you hereunder are reserved by ficox; (d) you acquire no ownership or other interest (other than your limited license rights) in or to the Course Content. You agree that you will not, at any time, contest anywhere in the world ficox’s ownership of the Course Content.

2. License Grant & Access

Upon your acceptance of these terms and successful payment of the applicable fees, ficox grants you a personal, non-exclusive, non-transferable, and limited license to access and use the Course Content solely for your own personal, educational, and non-commercial purposes.

Account Security: The Course Content is accessible exclusively via a secure, password-protected online member area. Your license is strictly limited to you as a single named user. You may not share your login credentials, account access, or any Course Content with any third parties.

Downloadable Materials: While the core course is a web-based online experience, certain supplementary training materials (such as presets, samples, or PDFs) may be provided as downloadable files. You may download and store a reasonable number of copies of these specific downloadable materials on your personal devices solely for your own backup and personal use.

3. Limitations & Restrictions

You may not under any circumstances: (a) modify, adapt, alter, translate, or create derivative works of the Course Content; (b) lease, rent, loan, or sell access to the Course Content to any third party; (c) sublicense, distribute, share, or otherwise transfer the Course Content or any component thereof (including downloadable materials); (d) record, capture, or stream the online video lessons; (e) remove, alter, or obscure any confidentiality or proprietary notices (including copyright and trademark notices) of ficox; (f) allow third parties to access or use the Course Content using your login credentials; or (g) reverse engineer, decompile, or disassemble the Course Content or any provided software/presets.

4. No Warranty

The Course Content and all related materials are provided on an "as is" basis, without any representation or warranty of any kind, either express or implied, including without limitation any representations regarding the results, performance, appropriateness, accuracy, reliability, or correctness of the Course Content. The entire risk as to the use of the Course Content is assumed by you.

ficox does not assume liability for the use of the Course Content: in no event shall ficox be liable for any damages whatsoever (including, without limitation, damages for loss of business profits, business interruption, loss of business information, or any other pecuniary loss) arising out of the use of or inability to use the Course Content, even if ficox has been advised of the possibility of such damages. In jurisdictions that do not allow the exclusion or limitation of liability for consequential or incidental damages, ficox's liability will be limited to the amount of money you paid for the Course Content.

5. Services & Updates

ficox is not required under this license to provide any personalized training or one-on-one coaching services to you, unless explicitly stated in a separate agreement.

ficox reserves the right to modify, update, or improve the Course Content at any time. Any such updates will be deemed part of the Course Content and subject to the terms of this license. ficox also reserves the right to alter features, specifications, and availability of the online platform.

During your active access to the Course Content, ficox will provide basic technical support in response to email requests regarding platform access or downloadable materials.

6. Termination

Without prejudice to any other rights, ficox may terminate this License Agreement and revoke your access to the member area immediately if you fail to comply with the terms and conditions of this License Agreement, including account sharing or unauthorized distribution of materials.

In such an event, all rights granted under this License Agreement will immediately terminate, and you must destroy all copies of any downloadable materials in your possession.

This License Agreement constitutes the entire, final, and exclusive agreement between you and ficox regarding the specific license transaction described herein. If any provision of this license is held to be illegal, invalid, or unenforceable, the remainder of the provisions will remain in full force and effect.

7. Service Availability & Discontinuation

While I strive to provide uninterrupted access to the Course Content, I can't guarantee that the platform will be available at all times. The service may be subject to occasional downtime for maintenance, upgrades, or due to unforeseen technical issues.

Furthermore, ficox reserves the right to suspend, discontinue, or terminate the XpressPads service, the platform, or the business as a whole at any time, at its sole discretion, without prior notice or liability to you. In the event of a permanent discontinuation of the service, your access to the online member area and the Course Content will cease, and ficox shall not be liable for any refunds, damages, or losses resulting from such discontinuation.
